Treasurechit AR  Terms

Treasurechit AR  (“Effect Platforms”) enable you to create and/or Submit content for us to create Effects and/or Frames to be used by people in a range of products and services provided by the Treasurechit Company (collectively, “Our Products”). These Treasurechit AR  Terms (“Terms”) apply to any content you upload, share, submit, provide, or otherwise make available (collectively, “Submit”) in connection with the Effect Platforms (collectively, your “Effect Content”) and the Treasurechit Company' use of your Effect Content. For the avoidance of doubt, your Effect Content does not include Our Products or any other technology made available by the Treasurechit Company.

If you use or download any new Effect Platforms' features or tools, your use and download of such feature or tool may be subject to additional terms and conditions (in addition to these Terms). By using the Effect Platforms, including by Submitting your Effect Content in connection with the Effect Platforms, you agree to be bound by these Terms.

• Certain Definitions
• “Treasurechit Company” means us
• “Effects” means the creative elements Users can add to a photo or video.
• “User” means a user of any of Our Products.
• Any terms not defined in these Terms but defined in the Treasurechit Terms of Service (defined below) have the meaning given to them in the Treasurechit Terms of Service, as applicable.
• You are responsible for any Effect Content that you Submit to us in connection with the Effect Platforms.
• Your Effect Content must comply with our Community Standards (if you are a User of any other of Our Products), and our Treasurechit AR Policies.
• If you are submitting Effect Content on behalf of a Page, you (including the Effect Content) must comply with our Stores, Groups and Events Policies.
• We have the complete and unrestricted right to determine, in our sole discretion, whether to make your Effect Content available in Our Products.
• If we make your Effect Content available to Users, we will do our best to deliver your Effect Content to the audience you specify (via the Effect Platforms tools), but we cannot guarantee in every instance that your Effect Content will reach its intended audience.
• We may modify, suspend, or terminate access to, or discontinue at any time the Effect Platforms and/or your Effect Content, including if your Effect Content violates these Terms.
• You represent and warrant that:
• you own your Effect Content or otherwise have all rights necessary to Submit your Effect Content and to grant the licenses to use your Effect Content as set forth in these Terms;
• the use of your Effect Content as set forth in these Terms does not infringe, misappropriate or otherwise violate the patent, copyright, trademark, privacy, publicity (including image, voice, and likeness) rights or any other rights of any person or entity, or otherwise violate the law;
• you agree to pay for all royalties, fees, and any other monies owed by reason of use of your Effect Content as set forth in these Terms; and
• if you are Submitting Effect Content on behalf of a third party, you have the authority as agent to such party to Submit such Effect Content on its behalf and to bind such party to these Terms.
• If you Submit any marks, names, logos, promotional credits, key art, title treatments, or other attribution with your Effect Content (collectively, “Attribution”), such Attribution will be deemed part of your Effect Content. We have the right, but are under no obligation, to provide such Attribution with your Effect Content. You give us the right to publicize, demonstrate or feature your use of the Effect Platforms throughout the world in perpetuity in any and all media, including but not limited to through the use of your name, brand, logos and Effect Content.
• You own your Effect Content. You hereby grant to the Treasurechit Company a worldwide, irrevocable and perpetual (subject to the applicable Deactivation Request defined below), royalty free, sub-licensable (to Users) license to copy, reproduce, modify, edit, make derivative works of, publicly perform, publicly display, distribute, communicate to the public and otherwise use your Effect Content in connection with (a) providing Users the applicable Effect through Our Products (which for the avoidance of doubt, may include modifications for technical compatibility purposes) and (b) providing you the Effect Platforms. You understand that this license includes the right for the Treasurechit Company to make such Effect available to Users (subject to the applicable Deactivation Request defined below) to use the Effect with their photo or video (“User Created Content”) via the features and functionality provided through Our Products and to use the User Created Content, including to download, post, and share such User Created Content (publicly, privately, or otherwise).
• You may request (via the Effect Platforms tools) that Treasurechit or Instagram, as applicable, no longer allow your Effect Content to be made available to Users through Our Products (each, a “Deactivation Request”). For clarity, your Effect Content will remain in the Effect Platforms and in existing user generated media incorporating the Effect Content, but will no longer be made available to Users through Our Products after we process your Deactivation Request, unless you later request that the Effect Content be made available again (to the extent we make such option available). To the extent your Effect Content was made available in downloadable versions of Our Products, your Effect Content will remain in such previously downloaded versions and we have no obligation to require Users to upgrade to newer versions. Deactivation Requests do not limit the Treasurechit Company’ or any User’s rights under these Terms with respect to your Effect Content in such previously downloaded versions or to User Created Content (and we are under no obligation to remove any such content).
• To the extent we provide you or you receive or collect any information in connection with your Effect Content (“Effect Data”), you agree to the following:
• ensure any Effect Data is only shared with someone acting on your behalf, such as your service provider. You are responsible for ensuring your service providers protect any Effect Data, limit their use of that Effect Data solely as necessary to provide services to you, and keep it confidential and secure.
• don’t use Effect Data for any purpose except to provide the Effect Content directly associated with that Effect Data, or on an aggregated and anonymous basis and only to assess the performance and effectiveness of your Effect Content.
• don’t use Effect Data, including the targeting criteria for your Effect Content, to build, append to, edit, influence, or augment user profiles, including profiles associated with any mobile device identifier or other unique identifier that identifies any particular user, browser, computer or device.
• don't transfer any Effect Data (including anonymous, aggregate, or derived data) to any ad network, ad exchange, data broker or other advertising or monetization related service.

 In the event of any conflict between these Terms, these Terms will govern solely with respect to the subject matter herein and solely to the extent of the conflict.

To the extent you are a User of any other of Our Products, the Effect Platforms are part of “Treasurechit” under the Treasurechit Terms of Service, your use of the Effect Platforms is deemed part of your actions on “Treasurechit,” and your Effect Content (including to the extent applied to an Effect or to User Created Content) is deemed your “content”, each under the Treasurechit Terms of Service. In the event of any conflict between these Terms and the Treasurechit Terms of Service, these Terms will govern solely with respect to the subject matter herein and solely to the extent of the conflict.

These Terms are incorporated by reference into Treasurechit's Terms of Service. The words “include” and “including,” and variations thereof, will not be deemed to be terms of limitation, and will be deemed to be followed by the words “without limitation.” Any provision of these Terms, which ought to survive, shall survive any termination or expiration of these Terms. Treasurechit reserves the right to monitor or audit your compliance with Terms and to update these Terms from time to time. We can change the terms without notice and/or by notice effected by an update in the “last modified” date. Your continued use of the Effect Platforms constitutes acceptance of those changes.
